Understanding the Anti-slapp Statute

Speaker: Josh Borger of Berliner Cohen

Description of Event:  Josh Borger of Berliner Cohen. He will be presenting on the often misunderstood and underused anti-slapp statute.  The anti-SLAPP statute authorizes early dismissal of unmeritorious claims that interfere with a person's constitutional right of petition or free speech.  It involves a subset of conduct protected by the First Amendment.  It is often the most overlooked and powerful weapon in a litigator’s arsenal for numerous reasons, including the right to attorney’s fees (depending on the party) and the automatic stay of the case when it’s appealed.  This seminar will cover the extent to which it has been applied, recent authority expanding its case, the right to attorney’s fees, and the impact of the automatic stay on appeal.  


Bio:  Josh Borger is a litigation partner at Berliner Cohen in San Jose.  He has tried cases ranging from financial elder abuse, intellectual property licensing disputes, to commercial cannabis.  He has handled numerous anti-slapp motions before the superior courts and the courts of appeal
