Vocational Evaluations
This hour-long presentation will address two topics: Vocational Assessments in Divorce and Special Needs Assessments of the Disabled Adult Child. The presentation will begin with a brief overview of the vocational assessment process, discussing the 4320 factors considered by vocational experts, methodology, required documentation for assessment, EEO and Gavron orders, and the overall value of evaluations to the parties involved. The majority of the remaining time will be dedicated to real-life case studies involving four different assessments: The supported spouse with health limitations The unemployed spouse The primary custodial parent with a child (or adult child) with severe health issues The entrepreneurial under-earning former breadwinner Within these case study discussions, insights and effective strategies gained from years of experience will be shared, along with resources that contribute to a more accurate and fair evaluation, such as formal work evaluations, neuropsychological assessments, and functional capacity forms completed by medical professionals. The second part of the presentation will focus on special needs assessments of the adult disabled child under Family Law 3910(a). This section will cover how these assessments are conducted, the methodology used, relevant case law (including Drake), necessary documentation, and key insights and strategies.
This MCLE will be held in person at El Jardin, Santa Cruz, CA. Seating is limited. Registration will close once capacity has been met.
